Kolik z&nbsp;n\u00e1s se v&nbsp;tom ale opravdu vyzn\u00e1, \u017ee? A&nbsp;tak velk\u00e1 \u010d\u00e1st realitn\u00edch transakci prob\u00edh\u00e1 p\u0159es n\u011bjakou spole\u010dnost, nebo makl\u00e9\u0159e (\u0159\u00edkejme tomu spole\u010dn\u011b zkratkou \u201cRK\u201d), kter\u00fd si za sv\u00e9 slu\u017eby \u00fa\u010dtuje v\u00fd\u0161e uveden\u00fd poplatek. V&nbsp;p\u0159\u00edpad\u011b z\u00e1jmu o&nbsp;nemovitost V\u00e1m RK po\u0161le rezerva\u010dn\u00ed smlouvu, kde se zav\u00e1\u017eete ke koupi nemovitosti a&nbsp;z\u00e1rove\u0148 slo\u017e\u00edte rezerva\u010dn\u00ed poplatek, typicky ve v\u00fd\u0161i provize RK. Pokud v\u0161e dob\u0159e dopadne, tak Vy z\u00edsk\u00e1te nemovitost, prod\u00e1vaj\u00edc\u00ed kupn\u00ed cenu a&nbsp;RK svou provizi \u2013 tomu se d\u00e1 \u0159\u00edkat ide\u00e1ln\u00ed obchod. Bohu\u017eel velk\u00e1 \u010d\u00e1st p\u0159\u00edpad\u016f nejde jako \u201cpo m\u00e1sle\u201d a&nbsp;<strong>dostat n\u011bkdy sv\u016fj rezerva\u010dn\u00ed poplatek od RK zp\u00e1tky m\u016f\u017ee b\u00fdt tvrd\u00fd o\u0159\u00ed\u0161ek<\/strong>. Tak co tedy d\u011blat? Na co m\u00e1m nebo nem\u00e1m pr\u00e1vo? Jak si to nastavit, tak, abych byl dob\u0159e chr\u00e1n\u011bn? Jak na rezerva\u010dn\u00ed smlouvu s&nbsp;RK.<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Nejprve bych r\u00e1d zd\u016fraznil, \u017ee pokud RK odvede svou pr\u00e1ci, ud\u011bl\u00e1 v\u0161e, co deklarovala na prohl\u00eddce, nemovitost je ve stavu, v&nbsp;jak\u00e9m jste se domluvili, pak je jen f\u00e9r, \u017ee si za sv\u00e9 slu\u017eby nech\u00e1 zaplatit a&nbsp;\u017ee z\u00e1jemce (tedy budouc\u00ed kupuj\u00edc\u00ed), kter\u00fd skl\u00e1d\u00e1 z\u00e1lohu, je smluvn\u011b povinov\u00e1n obchod bu\u010f dokon\u010dit, nebo \u201cod\u0161kodnit\u201d RK za odvedenou pr\u00e1ci v&nbsp;p\u0159\u00edpad\u011b, kdy se rozhodne koupi neuskute\u010dnit. Zp\u016fsob a&nbsp;v\u00fd\u0161e by samoz\u0159ejm\u011b m\u011bla odpov\u00eddat situaci. Realitn\u00ed trh nen\u00ed jako samoobsluha, kde si d\u00e1te do ko\u0161\u00edku v\u011bci, ale dokud je nezaplat\u00edte, tak je m\u016f\u017eete bezplatn\u011b vr\u00e1tit. Pokud se V\u00e1m RK aktivn\u011b v\u011bnuje, tedy \u010din\u00ed smluvn\u00ed a&nbsp;faktick\u00e9 kroky k&nbsp;prodeji nemovitosti a&nbsp;vy si danou v\u011bc rezervujete, tedy podep\u00ed\u0161ete rezerva\u010dn\u00ed smlouvu, ji\u017e jste v\u00e1z\u00e1ni a&nbsp;bylo by naivn\u00ed si myslet, \u017ee kdykoliv m\u016f\u017eete couvnout a&nbsp;dostat celou \u010d\u00e1stku zp\u00e1tky, jen proto, \u017ee jste si to z&nbsp;d\u016fvod\u016f na sv\u00e9 stran\u011b rozmysleli.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Obecn\u011b vid\u00edm takov\u00fdch 5 okruh\u016f, kter\u00e9 je pot\u0159eba prozkoumat p\u0159ed podpisem rezerva\u010dn\u00ed smlouvy:<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h6>1.&nbsp;\u00daschova u&nbsp;advok\u00e1ta<\/h6>\n<h6>2. Trojstrannost<\/h6>\n<h6>3. Advok\u00e1tn\u00ed kontrola<\/h6>\n<h6>4. Nakl\u00e1d\u00e1n\u00ed s&nbsp;rezervac\u00ed<\/h6>\n<h6>5.&nbsp;\u0158e\u0161en\u00ed konflikt\u016f<\/h6>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">1. Ka\u017ed\u00e1 RK od V\u00e1s bude cht\u00edt z\u00edskat rezerva\u010dn\u00ed \u010d\u00e1stku co nejd\u0159\u00edve. V\u011bt\u0161ina RK V\u00e1s bude tak\u00e9 sm\u011b\u0159ovat na to, abyste jim rezervaci poslali na jejich \u00fa\u010det. Ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f k&nbsp;tomu skute\u010dn\u011b tak i&nbsp;dojde, ale pokud se n\u011bco v&nbsp;pr\u016fb\u011bhu pokaz\u00ed, pak je RK ve v\u00fdrazn\u011b siln\u011bj\u0161\u00ed pozici, proto\u017ee pen\u00edze ji\u017e maj\u00ed a&nbsp;jste to naopak Vy, kdo se mus\u00ed dom\u00e1hat navr\u00e1cen\u00ed rezervace, co\u017e mnohdy znamen\u00e1 se minim\u00e1ln\u011b obr\u00e1tit na advok\u00e1ta a&nbsp;d\u00e1t dohromady p\u0159ed\u017ealobn\u00ed v\u00fdzvu, ale \u010dasto i&nbsp;d\u00e1t RK k&nbsp;soudu. Proto <strong>nejbezpe\u010dn\u011bj\u0161\u00edm zp\u016fsobem je i&nbsp;na rezervaci vytvo\u0159it \u00faschovu u&nbsp;advok\u00e1ta\/not\u00e1\u0159e<\/strong> (ne tedy u&nbsp;RK), kde se jasn\u011b stanov\u00ed, co se s&nbsp;pen\u011bzi stane a&nbsp;za jak\u00fdch podm\u00ednek V\u00e1m budou vr\u00e1ceny. Po\u010d\u00edtejte nicm\u00e9n\u011b, \u017ee danou \u00faschovu si zaplat\u00edte, ale obecn\u011b byste se m\u011bli vej\u00edt do 5000&nbsp;K\u010d. P\u0159eci jenom je lep\u0161\u00ed zaplatit 5000&nbsp;K\u010d za smlouvu ne\u017e se pak h\u00e1dat nap\u0159\u00edklad o&nbsp;300&nbsp;000&nbsp;K\u010d.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">2. Jak by takov\u00e1 spr\u00e1vn\u00e1 rezerva\u010dn\u00ed smlouva m\u011bla vypadat? Ur\u010dit\u011b a&nbsp;jednozna\u010dn\u011b <strong>V\u017dDY trojstrann\u00e1<\/strong>. To znamen\u00e1, \u017ee subjekty by m\u011bly b\u00fdt z\u00e1jemce\/budouc\u00ed kupuj\u00edc\u00ed, RK, kter\u00e1 prodej zprost\u0159edkov\u00e1v\u00e1 a&nbsp;prod\u00e1vaj\u00edc\u00ed. Prod\u00e1vaj\u00edc\u00ed klidn\u011b m\u016f\u017ee b\u00fdt zastoupen platn\u011b podepsanou a&nbsp;ov\u011b\u0159enou plnou moc\u00ed RK nebo n\u011bk\u00fdm jin\u00fdm, ale je d\u016fle\u017eit\u00e9, aby i&nbsp;on v&nbsp;rezerva\u010dn\u00ed smlouv\u011b figuroval. P\u0159eci jenom kupujete si jeho nemovitost, a&nbsp;tak je lep\u0161\u00ed, kdy\u017e on s\u00e1m uvede, \u017ee nemovitost m\u00e1 z\u00e1jem prodat, ne\u017e kdy\u017e je to pouze deklarov\u00e1no danou RK. V&nbsp;praxi se m\u016f\u017eete v\u00fdjime\u010dn\u011b setkat i&nbsp;s&nbsp;t\u00edm, \u017ee byste mohli m\u00edt rezerva\u010dn\u00ed smlouvu mezi V\u00e1m a&nbsp;p\u0159\u00edmo prod\u00e1vaj\u00edc\u00edm, tedy bez RK &#8211; k&nbsp;tomu lze \u0159\u00edct, \u017ee pokud budou pen\u00edze v&nbsp;\u00faschov\u011b, pak i&nbsp;tento model je p\u0159ijateln\u00fd. Nicm\u00e9n\u011b odrazoval bych od podepisov\u00e1n\u00ed smluv pouze s&nbsp;RK, kde se dostanete na vztah B2C a&nbsp;kde \u010dasto nast\u00e1vaj\u00ed probl\u00e9my v&nbsp;p\u0159\u00edpad\u011b snahy o&nbsp;rozchod.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">3. I&nbsp;kdy\u017e si sami pro\u010dtete smlouvy a&nbsp;zjist\u00edte, \u017ee na prvn\u00ed pohled to vypad\u00e1 dob\u0159e, mo\u017en\u00e1 si dokonce pro z\u00e1bavu pro\u010dtete p\u0159\u00edslu\u0161n\u00e1 ustanoven\u00ed Ob\u010dansk\u00e9ho z\u00e1kon\u00edku (89\/2012 Sb.) nebo z\u00e1kona o&nbsp;realitn\u00edm zprost\u0159edkov\u00e1n\u00ed (39\/2020 Sb.), <strong>rozhodn\u011b si najm\u011bte advok\u00e1ta<\/strong>. Op\u011bt je to \u0159ekn\u011bme 5000\u201320000&nbsp;K\u010d za pr\u00e1vn\u00ed posouzen\u00ed\/\u010d\u00e1ste\u010dn\u00e9 zastoupen\u00ed a&nbsp;pokud kupujete nemovitost za 10 milion\u016f K\u010d, pak to jsou moud\u0159e investovan\u00e9 pen\u00edze. I&nbsp;jedna v\u011bta, kter\u00e1 zn\u00ed nevin\u011b, V\u00e1m m\u016f\u017ee p\u0159in\u00e9st spoustu starost\u00ed. Chcete p\u0159\u00edklad? Jist\u011b to je takov\u00fd hodn\u011b vyhrocen\u00fd p\u0159\u00edpad, ale jen pro jistotu vyberte si advok\u00e1ta s&nbsp;dobr\u00fdm renom\u00e9, ide\u00e1ln\u011b toho, koho ji\u017e dlouho zn\u00e1te a&nbsp;pou\u017e\u00edv\u00e1te.
